Terms of Service
Effective date: 30 May 2026
These Terms of Service ("Terms") govern your access to and use of Surgibud ("we", "us", or "our"), a surgical logbook, audit, and reflection platform. By creating an account or using Surgibud you agree to these Terms. If you do not agree, do not use the service.
1. Who may use Surgibud
Surgibud is intended solely for use by registered medical practitioners, surgical trainees, and other qualified health professionals ("Clinicians"). By registering, you represent that you are a Clinician with the appropriate qualifications and registration to perform or supervise the surgical procedures you record.
Surgibud is not a clinical decision-support system and must never be used as the primary basis for clinical decisions. All clinical judgement remains with the treating clinician.
2. Your account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must:
- Provide accurate and complete information when registering
- Notify us immediately at support@surgibud.com if you become aware of any unauthorised access
- Not share your account with others or use another person's account
- Enable multi-factor authentication if required by your employer or health organisation
3. Acceptable use
You may use Surgibud to record and manage your own surgical cases, generate statistics for personal professional audit and appraisal, and share case records with authorised colleagues. You must not:
- Record any information that directly identifies a patient (including names, National Health Index (NHI) numbers, IRD numbers, Medicare numbers, dates of birth, or contact details other than through the designated encrypted PROM contact field)
- Use Surgibud for the primary medical record of a patient — it is a personal professional logbook only
- Attempt to reverse-engineer, scrape, or extract data from the platform
- Use the AI features to generate content that you intend to pass off as your own unassisted clinical documentation without review
- Violate any applicable laws, including the Health Information Privacy Code 2020 (New Zealand) or the Australian Privacy Act 1988 (Cth)
4. Patient data and de-identification
Surgibud is designed around a de-identified data model. The "Patient ID" field is intended for a clinician-assigned non-identifying reference code (e.g. "WGN-001"), not a name or official identifier. You are solely responsible for ensuring that any information you enter does not constitute identifiable patient information under the Privacy Act 2020 (New Zealand) or the Privacy Act 1988 (Cth) (Australia).
Patient contact details entered for the purpose of PROM (Patient-Reported Outcome Measure) survey delivery are encrypted at rest and automatically deleted once all scheduled surveys have been sent. These details are used only to deliver the surveys and are never accessible to Surgibud staff.
5. AI features
Surgibud offers AI-powered features including automated field extraction from clinical notes and AI-enhanced reflection drafting. These features are:
- Provided as productivity aids only — all AI-generated content must be reviewed, verified, and corrected by you before saving
- Not a substitute for professional clinical documentation standards
- Subject to usage limits (currently 10 requests per hour per user)
Text and images you submit to AI features are processed by Anthropic (see our Privacy Policy). Do not submit identifiable patient information to AI features.
6. Case sharing
The case sharing feature allows you to send copies of your logbook entries to other Surgibud users. When you share a case:
- The recipient receives an independent copy — they cannot modify your original records
- You are responsible for ensuring you have appropriate authority to share the information contained in the case record, consistent with your professional obligations and your employer's policies
- Share links expire after 7 days and can be accepted by up to 5 recipients
7. Data ownership and intellectual property
You retain ownership of the surgical case data you enter. By using Surgibud you grant us a limited licence to store, process, and display your data solely to provide the service to you. We do not use your case data for training AI models or for any commercial purpose beyond providing the service.
Surgibud's software, design, and content are our intellectual property and must not be copied or reproduced without permission.
8. Service availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may suspend or modify the service for maintenance, updates, or circumstances outside our control. We will endeavour to give reasonable notice of planned downtime.
9. Disclaimer and limitation of liability
Surgibud is provided "as is". To the maximum extent permitted by law (including the Consumer Guarantees Act 1993 (New Zealand) and the Australian Consumer Law), we disclaim all implied warranties.
We are not liable for:
- Clinical decisions made in reliance on data recorded in Surgibud
- Loss of data due to circumstances outside our reasonable control
- Any indirect, consequential, or incidental loss arising from your use of the service
Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded or limited under New Zealand or Australian consumer law.
10. Termination
You may close your account at any time via Settings → Delete Account. We may suspend or terminate your account if you breach these Terms or if required by law. On termination, your data is deleted in accordance with our Privacy Policy and applicable medical record retention obligations.
11. Governing law
These Terms are governed by the laws of New Zealand. Disputes will be subject to the exclusive jurisdiction of the New Zealand courts, except where mandatory consumer protection laws of another jurisdiction (including Australia) provide otherwise.
Australian users: to the extent required by Australian law, your statutory rights under the Australian Consumer Law are not affected by these Terms.
12. Changes to these Terms
We may update these Terms from time to time. We will notify you by email or within the application before material changes take effect. Continued use of Surgibud after changes are notified constitutes acceptance.
